Terms of Service
Terms governing access to and use of the MailBeacon email validation service.

1. Agreement and eligibility
These Terms of Service (“Terms”) form an agreement between you and the person or entity operating the MailBeacon service (“MailBeacon,” “we,” “us,” or “our”). By creating an account, purchasing tokens, or accessing the website, dashboard, or API, you agree to these Terms.
You must be at least 18 years old or the age of legal majority where you live. If you use MailBeacon for a company or another organization, you confirm that you have authority to bind it, and “you” includes that organization.
If you do not agree to these Terms, do not access or use the service.
2. The service and its results
MailBeacon provides real-time and bulk email validation tools. Results are automated assessments based on technical signals available at the time of a check, such as syntax, DNS and MX records, provider behavior, and SMTP responses.
Email systems change and some providers intentionally obscure mailbox status. A result may therefore be valid, invalid, unknown, incomplete, delayed, or occasionally incorrect. MailBeacon does not guarantee that an address belongs to a particular person, will accept mail in the future, will engage with a message, or will improve campaign deliverability.
You are responsible for deciding how to use each result. Do not use MailBeacon as the sole basis for decisions involving employment, credit, housing, insurance, healthcare, legal rights, or other similarly significant eligibility decisions.
3. Accounts and API keys
You must provide accurate account information and keep it current. You are responsible for safeguarding your password and API keys, limiting access to authorized users, and all activity performed through your credentials.
Do not publish, sell, or share API keys outside your organization. Notify us promptly at support@mailbeacon.co if you suspect unauthorized access. We may revoke or rotate credentials when reasonably necessary to protect you, MailBeacon, or others.
4. Your data and lawful use
You retain your rights in email addresses, files, and other data you submit (“Customer Data”). You grant MailBeacon a limited, non-exclusive right to host, copy, transmit, and process Customer Data only as reasonably needed to provide, secure, troubleshoot, and support the service or comply with law. How we handle Customer Data and account information is described in our Privacy Policy.
You confirm that you obtained Customer Data lawfully and have all notices, permissions, consents, and other legal bases required to submit and use it. MailBeacon does not determine whether your list was collected lawfully and does not provide consent for you to contact anyone.
Do not submit passwords, payment-card data, government identifiers, health information, or other sensitive information that is not necessary for email validation. We may use aggregated or de-identified service metrics to maintain and improve MailBeacon, provided they cannot reasonably identify you or any individual.
5. Acceptable use
You may not use MailBeacon to:
- send spam, facilitate unsolicited messaging, harass people, or violate privacy, marketing, anti-spam, or data-protection laws;
- validate data obtained through theft, scraping, deception, or another source you are not authorized to use;
- probe or bypass security, rate limits, authentication, or token controls, or interfere with the service or another customer;
- upload malware, automate abusive traffic, reverse engineer the service where prohibited, or use results to build a competing validation database;
- resell, sublicense, or provide shared access to MailBeacon without our written permission; or
- violate applicable law, sanctions, export controls, or another person’s rights.
We may apply reasonable technical limits, reject harmful requests, and investigate suspected misuse.
6. Tokens, pricing, and payment
MailBeacon currently sells one-time token packs. Prices, included features, and charging rules shown at checkout or in the documentation apply when you purchase. Prices are in U.S. dollars unless stated otherwise, and you are responsible for applicable taxes.
Payments are processed by a third-party payment provider. Tokens have no cash value, are not legal tender, and may not be transferred or resold. We may remove tokens associated with a refund, reversed payment, fraud, or promotional abuse.
Tokens do not expire under the current offering. If MailBeacon permanently discontinues the paid service, we will provide a reasonable opportunity to use remaining paid tokens or offer a refund or credit for eligible unused paid tokens, unless your account was terminated for a serious breach of these Terms.
We may change prices or charging rules prospectively, but a change will not alter a completed purchase. Refund eligibility is governed by the Refund Policy and any mandatory rights under applicable law.
7. Ownership and feedback
MailBeacon and its licensors own the service, software, branding, documentation, and related intellectual property. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the service for your internal personal or business purposes.
You may use validation results generated for your Customer Data for your lawful business purposes. If you send suggestions or feedback, you allow us to use them without restriction or payment, but we will not identify you publicly as the source without permission.
8. Availability and changes
We work to keep MailBeacon reliable, but do not promise uninterrupted access or a particular uptime unless a separate written service agreement says otherwise. Maintenance, network failures, provider behavior, abuse prevention, and events outside our control may affect availability or results.
We may improve, replace, or discontinue features. When a change materially reduces a paid feature, we will provide reasonable notice when practical and a fair remedy for materially affected unused paid tokens. Beta or preview features may change or end at any time.
9. Suspension and termination
We may suspend or limit access when reasonably necessary to address a security risk, suspected fraud, nonpayment, a chargeback, unlawful activity, material breach, excessive technical impact, or a legal requirement. When practical, we will explain the reason and allow a reasonable opportunity to correct the issue.
We may terminate an account for a serious or repeated breach. You may stop using MailBeacon at any time. On termination, your right to use the service ends, but provisions that by their nature should survive will remain effective, including ownership, disclaimers, liability limits, indemnification, and dispute terms. Refunds for unused tokens remain subject to the Refund Policy and applicable law.
10. Third-party services
MailBeacon relies on third-party infrastructure, payment processors, analytics, networks, and email providers. Their services may be subject to separate terms and may change or become unavailable. We are not responsible for third-party systems outside our reasonable control, but we remain responsible for the commitments we expressly make in these Terms.
11. Disclaimers
To the maximum extent permitted by law, MailBeacon is provided “as is” and “as available.” Except for express promises in these Terms, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, and uninterrupted availability.
These disclaimers do not exclude warranties or consumer protections that cannot lawfully be excluded.
12. Limitation of liability
To the maximum extent permitted by law, MailBeacon, its owner, affiliates, contractors, and suppliers will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, revenue, goodwill, business opportunities, or data, arising from the service.
Their total aggregate liability arising out of or relating to the service or these Terms will not exceed the greater of (a) the amount you paid MailBeacon during the 12 months before the event giving rise to the claim or (b) US $100.
Nothing in these Terms limits liability for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited.
13. Indemnification
To the extent permitted by law, you will defend, indemnify, and hold harmless MailBeacon, its owner, affiliates, and contractors from third-party claims, damages, and reasonable costs arising from your Customer Data, your unlawful or abusive use of the service, or your material breach of these Terms.
We will promptly notify you of a covered claim and reasonably cooperate at your expense. You may control the defense, but may not settle a claim in a way that admits fault by or imposes an obligation on MailBeacon without our written consent.
14. Disputes and governing law
Before filing a formal claim, you and MailBeacon agree to try in good faith to resolve the dispute for at least 30 days after written notice is received at support@mailbeacon.co.
These Terms are governed by the laws applicable where MailBeacon’s operator has its principal place of business, without regard to conflict-of-law rules. Courts located there will have jurisdiction, except where mandatory consumer law permits you to bring a claim in another location or requires another governing law.
15. Changes to these Terms
We may update these Terms to reflect service, legal, or operational changes. We will update the date above and provide reasonable notice of material changes when practical. Changes apply prospectively and will not retroactively remove an accrued refund right or reduce an existing paid token balance.
If you do not agree to updated Terms, stop using the service. Your continued use after the effective date means you accept the updated Terms.
16. General terms
These Terms, the Privacy Policy, the Refund Policy, and any separate written agreement between you and MailBeacon are the entire agreement concerning the service. A separate signed agreement controls if it expressly conflicts with these Terms.
You may not assign these Terms without our consent. We may assign them as part of a financing, reorganization, merger, acquisition, or sale of the service. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be narrowed only as needed, and the remaining provisions will continue.
Neither party is liable for delay caused by events beyond its reasonable control, except that this does not excuse payment obligations already incurred.
